1Scope and Legal Force of this Policy

1.1

Nature of the Platform. "Imdad" is an electronic application and a digital portal specialised in the construction and contracting sector. It enables Clients (Service Requesters) to request construction equipment and building materials, and enables Service Providers to submit price quotations for the equipment and services requested.

1.2

Owner and Operator. The Platform is managed and operated by Imdad Equipment Commercial Brokerage Company, a company registered under the laws of the Kingdom of Saudi Arabia under Commercial Registration No. [0000], with its head office at [000].

1.3

Legal Force of this Document. This Privacy Policy forms an integral part of the Terms of Use and of the brokerage contract. Continued browsing or use of the Platform constitutes an acknowledgement that the User has read, understood and accepted it. Should the User not agree to any provision, the User must immediately refrain from using the Platform.

2Definitions

For the purposes of this Policy, the following terms shall bear the meanings ascribed to them below, unless the context requires otherwise:

  • Platform / Intermediary: the "Imdad" (Imdad Equipment) application and website, including the applications available on the Apple App Store and Google Play, and internet browsers.
  • User: any natural or legal person who accesses, registers on, or uses the Platform in any capacity.
  • Service Requester (Client): the entity or individual using the Platform to request construction equipment (heavy or hand-operated), materials, or the services available.
  • Service Provider: the commercial establishments or companies registered on the Platform to provide equipment leasing/supply services, or the supply and transport of building materials.
  • Account: the digital profile of the User registered on the Platform.
  • Order / Price Quotations: the electronic process exchanged between the Service Requester and the Service Provider through the Platform for the purpose of determining the specifications and cost of the Service.
  • Applicable Laws: the laws and regulations in force in the Kingdom of Saudi Arabia and the relevant Gulf Cooperation Council states.

3Legislative Compliance

In processing data and providing intermediation services, the Platform complies with the laws and legislation applicable in the Gulf states, foremost among them:

  • the Saudi Personal Data Protection Law (PDPL);
  • the Personal Data Protection Law of the United Arab Emirates;
  • the Personal Data Privacy Protection Law of the State of Qatar;
  • the relevant laws and regulations of the Gulf states.

4Legal Basis for Data Processing

In collecting and processing User data, the Platform relies on:

  • the express consent of the User (given at registration or upon enabling permissions such as geolocation);
  • the necessity of performing the contract and the services exchanged between the parties;
  • legal and regulatory obligations imposed by governmental authorities;
  • the legitimate interest relating to the security of the Platform, the development of the Services, and the prevention of fraud.

5Data We Collect

The application handles two categories of Users, together with sensitive technical data collected to the minimum extent necessary:

5.1

Service Provider data: full name, telephone number, email address, commercial registration or professional licence, type and specifications of equipment, place of business, and financial collection details where required.

5.2

Service Requester (Client) data: full name, telephone number, email address, company or project name (if any), project location, order details, and the requested rental period.

5.3

Usage and transaction data: orders and price quotations, contracts concluded, messages and internal conversations between the parties, and ratings and reviews.

5.4

Technical and location data: device type, operating system, IP address, network data, performance logs, and geolocation data (which is accessed only with express consent, for the purpose of identifying the nearest Service Providers, calculating transport costs, and improving search results, and which may be disabled from the device settings at any time).

6Purposes of Data Use and Data Sharing

6.1

Purposes of use. Data is used to create and administer Accounts, process orders, facilitate communication and the conclusion of contracting transactions between Clients and Service Providers, develop and improve the User experience, verify identity and prevent fraud, send operational notifications, and send marketing messages (after obtaining the User's consent).

6.2

Data sharing. Data is shared to the minimum extent necessary to carry out operations, with:

  • Service Providers (for the purpose of reviewing orders and submitting quotations) and Clients (for the purpose of reviewing equipment details);
  • supporting technical service providers (hosting, analytics, electronic payment);
  • governmental and judicial authorities where a statutory obligation exists.
6.3

Privacy guarantees.

  • The Platform does not sell personal data to any third party under any circumstances.
  • Data is not shared for external advertising purposes without express consent.
  • Data is not transferred outside the Gulf Cooperation Council states except in accordance with the appropriate regulatory controls and laws.

7Information Security and Data Retention

7.1

Security measures. The Platform undertakes to protect data by means of encryption (in transit and at rest), firewalls, strict access controls, continuous monitoring, periodic security testing, and backups. In the event of any material security breach, immediate statutory measures will be taken and the competent authorities and affected individuals will be notified.

7.2

Retention periods.

  • Active account data: for the duration of use of the Account.
  • Financial and contractual transaction records: 5 years.
  • Communication and correspondence records: one year.
  • Technical logs and cookies: 90 days.
  • Cancelled accounts: securely deleted within 30 days of the cancellation request.

8User Rights and their Exercise

Under the applicable data protection laws, the User (whether Service Requester or Service Provider) has the right to:

  • access their personal data and request a copy of it;
  • request the correction or updating of inaccurate data;
  • request the erasure of data (in accordance with the regulatory controls, and to the extent not inconsistent with existing financial transaction records);
  • withdraw consent to processing, or restrict it, at any time;
  • lodge a complaint with the competent supervisory authority in the event of a violation.

Mechanism for exercising rights. Requests are submitted through the privacy section within the application, or by email to info@imdad-equipments-sa.com. The Platform undertakes to respond to lawful requests within 15 business days.

9Confidentiality of Inter-Party Data

The Platform, as well as each of the Service Provider and the Service Requester, undertakes to preserve the confidentiality of the data entered or exchanged in the course of carrying out transactions. Such data may not be disclosed to any third party except pursuant to an official request from the competent governmental or judicial authorities.

10Amendment of this Policy

The Platform is entitled to update and amend these Terms of Use and this Privacy Policy at any time (particularly following the conclusion of the trial period). Amendments take effect immediately upon their publication on the Platform. Where amendments are material, or updates affect data protection, Users shall be notified in advance by email or by a prominent in-application notice, and re-consent may be required for continued use of the Service.

11Governing Law and Dispute Resolution

11.1

Governing Law. This Agreement in all its provisions (Terms of Use and Privacy Policy) is governed by, and shall be construed in accordance with, the laws and regulations of the Kingdom of Saudi Arabia.

11.2

Dispute Resolution. Any dispute arising between the Platform and any of the parties, or between the parties to the contractual transaction concluded through the Platform, which cannot be resolved amicably, shall be referred to an arbitral tribunal composed of three arbitrators in accordance with the Saudi Arbitration Law. The place of arbitration and of enforcement shall be the city of Makkah Al-Mukarramah.

11.3

General and Supplementary Provisions. The Arabic language is the authoritative reference for the interpretation of these provisions. Any matter not expressly covered by this Agreement shall be governed by the laws and decisions in force in the Kingdom of Saudi Arabia.
